With the recent policy change that Canada will no longer process work permit applications for individuals on visitor status, those currently in Canada on a visitor visa might be concerned about their options. Here’s what you need to know about extending your visitor status and maintaining lawful status in Canada.
Recent Policy Change
Until August 28, 2024, visitors in Canada were allowed to apply for work permits from within the country as part of temporary measures introduced during the COVID-19 pandemic. This policy helped newcomers who were unable to travel due to restrictions and provided a solution to fill critical job vacancies. However, with the economic recovery—Canada has regained 138% of the jobs lost during the pandemic and the unemployment rate is at 6% as of June 2024—the Canadian government is phasing out these temporary measures.
Understanding Visitor Status in Canada
Visitor Visa:
A visitor visa, issued by Immigration, Refugees and Citizenship Canada (IRCC), permits foreign nationals to enter Canada temporarily. Some travelers may enter Canada with an electronic Travel Authorization (eTA) instead of a visa. Visitor visas are generally valid for up to ten years and often allow multiple entries into Canada.
Visitor Record:
Upon arrival in Canada, visitors may receive a visitor record from the Canada Border Services Agency (CBSA). This document is separate from your passport and typically allows you to stay in Canada for up to 183 days, although a border officer might set an earlier departure date. The visitor record will have an expiry date, and you must leave Canada by this date unless you extend your status.
Extending Your Visitor Status
To extend your visitor status in Canada, you must apply for an extension at least 30 days before your current status expires. Submit a separate application package to IRCC for processing.
If Your Status Has Already Expired:
If your temporary resident status (including work permits, visitor visas, or study permits) has expired, you cannot apply for an extension. However, you might be eligible to apply for a restoration of status within 90 days of the expiration. If 90 days have passed, you will need to leave Canada.
Maintaining Status While Awaiting Decisions
For individuals applying to extend their work or study permits, it is possible to remain in Canada under “maintained status” from the date IRCC receives your application until a decision is made. This status allows you to continue working or studying legally while your application is processed.
Proof of Maintained Status:
You can prove that you are maintaining status by showing proof of your application for permit extension. This documentation is crucial for ensuring that your stay remains lawful during the processing period.
